    Common Debt Collection Violations

If a debt collector did any of these, it may have violated the Fair Debt Collection Practices Act.

    Harassing Phone Calls

Repeated calls meant to annoy you, calls before 8 a.m. or after 9 p.m., or calls to your job after you said not to.

    Threats and Intimidation

Threats of arrest, jail, violence, or a lawsuit or garnishment the collector can't or won't actually take.

    Telling Others About Your Debt

Discussing your debt with family, friends, neighbors or your employer.

    Lies About the Debt

Wrong amounts, added fees not allowed by your agreement, or pretending to be a lawyer or government agency.

    Ignoring Your Dispute

Continuing to collect after you disputed the debt in writing, without first sending you verification.

    Collecting Time-Barred Debt

Suing or threatening to sue on old debt. In New York, most consumer debt lawsuits must be filed within 3 years.

What Can You Recover Under the FDCPA?

When a debt collector violates the Fair Debt Collection Practices Act, the law lets you sue for these remedies (15 U.S.C. § 1692k).

    Actual damages, including emotional distress
Statutory damages of up to $1,000
Attorney's fees and costs if you win
An end to the abusive collection practices
Your rights apply even if you owe the debt
